No, I'm sorry, I didn't make myself clear. I have neither the time nor the inclination to bore everyone with  HSE legislation. Health and Safety is not "obviously" the sole responsibility of the contractor. If a worker gets injured, the contractor, the Council, and anybody else who is aware of the risk but does not act, are potentially in the HSE's sights. Fact.

Have had confirmation, after re checking, that this had already beeen raised and being dealt with internally after previous contact @Phil .

Sorry did not make my self clear either. I meant main responsibility (mind you that is not really accurate either)  As you rightly state safety is everyones responsibility. I have re contacted the officers to specifically raise these concerns @Phil

Jay is excused (unless he is on the payroll of a relevant Council department) as am I (having asked for the contact details)....

Best bet "all in" is for you to, a) ask the officer yourself of b) PM me his/her details.

Please do not think the HSE would agree with you over responsibility. God forbid a worker gets hurt, we'd better hope Admin deletes this thread.... Alternatively, please PM the officers details and I'll ask him...

John, in light of Jay's post, I wrongly assumed you were contacting the officer concerned about why the workers seemed to be dodging traffic to perform their duties. Without wanting to come over all health and safety, perhaps you could ask for the contractors risk assessment and method statements? If we, the forum community, believe these workers are potentially being put at risk by their work environment, it would be irresponsible of us to not to bring it to the responsible officers attention....

I did refer the officer to this thread. The H+S would obviously be the contractors responsibility, but perhaps at a similar level to the work  :(

Have now had a response

"I understand that in my absence a colleague has investigated and arranged that the contractor returns to site. Any re-work of the defective areas will be carried out at the contractors expense."

Hopefully correctly this time  :)

I was there watching the poor guys do these repairs at 2:45 on the other side of marina/Claremont and the traffic flow picking up children up from MHS was relentless. No sooner has the Tarmac put in the holes the guys couldn't get the flattening machine in place before half a dozen cars had done their best to unevenly flatten it. The guys were basically playing chicken with uninterested impatient drivers! So yes it probably is a mess but it's only the road users who are to blame (oh and maybe the planner who should have done a little homework as to time of day)

A lot of patching has been done on Claremont Ave.   It is well know that if water can get in between the new tarmac and the current tarmac within a few years the repair will need to be done again.   Hence tar is used to seal the gap.

Looking at the work that has been done on the corner of Claremont Ave and Marina Dr, the tar has been put in so badly that is does not cover a lot of the joints.   (The old road was also not heated up before the new tarmac was put down, so it will not bond very well, and at least some of the joints were not sealed until the next day, so allowing water to get in.

Please can one of the councillors check the quality of work they have had done at our expense.

(If the work by the utility companies had been done to a correct standard in the first place, most of some of these patches would not be needed, so is virgin etc being charged for them?)
